Introduction:
These terms & conditions (together with the documents referred
to in the terms) apply to any orders for products placed on this
website, and to your use of the website. Please read them before
placing an order or using this website. You should print a copy
of these terms for future reference.
These terms and conditions will only apply to goods ordered from
our website and not direct sales where the customer visits our
premises to either pay for or to collect the goods. In all instances
your statutory rights as a consumer will not be affected.
If you do not agree with these terms, please do not use this
website and do not order products on the website.
We may change our terms at any time, so please do not assume
that the same terms will apply to future orders. You should always
read our terms & conditions before placing an order.
In this page, we call the terms & conditions the “terms
& conditions” and the “terms” and refer
to Ceritech Audio as "we" “us” and “our”.
Your status:
By placing an order through our site, you agree that:
(a) You can enter into binding contracts;
(b) If paying by credit or debit card that the products will be
dispatched to your credit or debit card address.

First Floor, 4 Lords Hill, Coleford Gloucestershire GL16 8BD.
We trade under the name “Ceritech Audio”. Please do
not send correspondence to our registered office address (see
Contacting us below).
In this contract, we call Ceritech “us”, “we”,
and “our”.

we will provide you with a returns address when we issue a returns
number (see Returns Policy below).
How a contract for the sale of products
is formed:
After placing an order, you will receive an email from us acknowledging
that we have received your order. Please note that this does not
mean that your order has been accepted. Your order constitutes
an offer to us to buy the relevant products. All orders are subject
to acceptance by us, and we will confirm such acceptance to you
by sending you an email that confirms that the products have been
dispatched (the Dispatch Confirmation). The contract between us
(Contract) will only be formed when we send you the Dispatch Confirmation.
The Contract will relate only to those products whose dispatch
we have confirmed in the Dispatch Confirmation. We will not be
obliged to supply any other products which may have been part
of your order until we confirm the dispatch of such products in
a separate Dispatch Confirmation.
If your order is conditional on all items being supplied, please
specify this in the "additional comments" box at the
point of purchase.
Orders for Goods:
When you order products on this website, you confirm that you
are purchasing the products in your basket and that you will pay
for these products in full. If you have selected an offline order
you confirm that it is your intention to purchase these products
and that you will dispatch payment without delay.
Product descriptions:
Product descriptions on this site can change at any time, for
example when a product is updated by the manufacturer. Changes
will not affect products for which you have already received a
Dispatch Confirmation.
Before placing an order, please check that the description meets
your needs.
Delivery of products:
Ceritech Audio offers fast, efficient and effective delivery on
all products ordered through our website.
We will send the products to the address you state when placing
the order. When you make a purchase using a credit/debit card,
we will only deliver the products to your card's registered address.
We want to deliver your goods to you as soon as we possibly can,
indeed a large percentage of our orders are delivered the very
next working day. However, because your order may not be in stock
with us and we have to wait for delivery from the manufacturers,
please allow 7 to 10 working days from placing your order for
delivery. We will deliver the products by the delivery date set
out in the Dispatch Confirmation or, if no delivery date is specified,
then within 30 days of the date of the Dispatch Confirmation,
unless there are exceptional circumstances.
Once the products have been delivered, they are your responsibility
and at your risk.
If the products are lost or damaged in transit, please let us
know as soon as possible.
Delivery of all products which are available in stock, will be
completed as a door-to-door service in the UK mainland only. We
currently do not ship outside the UK.
Certain products cannot be delivered to extreme parts of the
UK where other parts will incur an additional delivery charge.

Delivery Arrangements team on 0844 736 5719.
To give you this effective delivery service we use two delivery
solutions. The item(s) you order will determine the delivery company
used.
Interlink Express or other courier - Larger items including Hi-Fi
Components, Speakers, AV Systems, AV Components and larger accessories
are sent via Interlink Express or other courier within 3-5 working
days.
Royal Mail - Smaller accessories including CDs, Leads, and Speaker
Wire etc are sent via Royal Mail services either by First Class,
Recorded Delivery or Special Delivery Post within 3-5 working
days.
If the courier has been unable to deliver the goods you will
be left a card stating the local depot's address and telephone
number. If you then contact the depot you can arrange another
date for the delivery to be made - this must be to the same address.
Alternatively you can arrange to pick the goods up from the depot,
for which you will need some form of identification eg a driving
license.
Delivery charges
Our Delivery Charge is fixed at £5.95 per order on all items
within most of the UK Mainland.
Outside of this area the following courier-imposed surcharges
apply:
UK Mainland Excluding surcharge regions below, including Isle
of Wight & Anglesey: £5.95
Scottish Highlands & Islands; HS1-9, IV1-36, IV41-49, IV51-56,
KA27-28, KW1-3, KW5-17, PA20-49, PA60-78, PH17-26, PH30-44, PH49-50,
ZE1-3: £10
Off-shore Islands, Channel Islands & Northern Ireland Isles
of Man, Scilly, Channel Islands & Northern Ireland: £20
We are unable to deliver to customers beyond those regions listed
above.
All delivery charges include insurance.
Your right to cancel (consumers only):
If you are contracting as a consumer (that is, not buying products
for a business or organisation), the following right applies to
you.
If you are contracting as a consumer, you may cancel a Contract
(for any reason at all) at any time within 7 working days, beginning
on the day after you received the products. In this case, you
will receive a full refund of the price paid for the products
in accordance with our refunds policy (set out below).
To cancel a Contract, you must inform us by telephone on 0844
736 5719, whereupon we will provide you with further instructions.
You must return the products to us immediately at your own cost
and risk.
You will not have any right to cancel a Contract for the supply
of products that have been customised for you, such as pre-cut
or terminated speaker cables. This provision does not affect your
statutory rights.
Returns Policy:
Before returning products to us, you must keep them in your possession
and must take reasonable care of them.
When you return products to us we will examine the returned products
and will notify you of whether you are entitled to a refund.
What follows' below is the distance selling regulations, with
relation to our industry, that we follow and adhere to here at
Ceritech Audio.
1.1 In line with the Distance Selling Regulations 2000 you are
required to send a notice of cancellation in writing or another
durable medium, including fax or e-mail within seven working days
from receipt. Please state your customer account number, sale
number and reason for cancellation of the goods. A telephone call
is not enough to constitute a cancellation. .. such goods under
the cooling off period, the ownership of the goods will revert
to the supplier, exceptions to the right includes sealed software,
discs and tapes which have been opened. These will remain the
property of the consumer and will not be credited.
1.3 The regulations impose a responsibility on the consumer to
take reasonable care of any goods that have been supplied. The
obligation applies before as well as after the consumer has given
the notice of cancellation.
1.4 If you return the goods, you are under a duty to take reasonable
care of the goods and to see that they are received by us and
not damaged in transit, as such we advise our customers to retain
the original box and packaging materials provided with the goods.
1.5 We advise our customers that all accessories should be unopened;
including cabinets, remote controls, speaker wire, batteries and
scart leads, any accessories missing from the returned product
will incur an administration charge of £25.00 plus the replacement
cost from the manufacturer.
1.6 Goods that have not been cancelled within 7 working days under
the cooling off period will be refused. Goods that do not meet
the above criteria will be subjected to additional surcharges.
All transactions processed comply with the Distance Selling Regulations
2000 for more details visit www.dti.gov.uk.
1.7 Goods that have been purchased and have failed within 14 days
of receipt will be collected inspected and repaired, replaced
or refunded if they do not fall within manufacturers specifications,
this does not affect your statutory rights.
1.8 You should complete a written notification that should be
sent back via post, fax or email to info@ceritech.co.uk detailing
your problem.
1.9 Goods that we find working to manufacturers specifications
will be returned to you and the cost of the carriage charged to
your account. Any returned goods refused to be accepted back by
the customer will also incur direct costs at a minimum 15% of
the invoice price plus a flat rate of £25.00 administration
fee for processing.
1.10 If under the 7 working days "cooling off period"
you wish to have the goods returned, we can offer collection for
the return of the goods at cost to you, alternatively you can
arrange your own method of returning the goods to Ceritech Audio.
Please be aware if arranging your own return that you will need
to take out adequate insurance on the goods should they be damaged
in transit.
Defective products:
All defective products are subject to testing prior to repair
or exchange. If no fault is present then we reserve the right
to charge a testing fee and to charge for return carriage.
Pricing:
We reserve the right to change prices of products without notice,
but such changes will not affect orders for which we have issued
a Dispatch Confirmation.
In the unlikely event that we have made a pricing mistake, we
will advise you of this. You will not receive an email confirming
acceptance of your order, and there will be no contract between
us.
The prices stated on the website include VAT but do not include
the cost of delivery, which is quoted for separately during the
order process.
As you may have gathered by now, we're not about selling clearance
items cheaply. We take pride in providing high quality equipment
together with a genuine commitment to customer service. Many of
the items we deal with are exclusive, and varying pricing isn't
an issue. On the more readily available lines, we've done our
utmost to ensure that our prices are competitive with the box
shifting businesses. If you see anything we sell cheaper elsewhere,
please let us know. If we can, we'll happily remedy the situation.
Special offers:
All offers are limited in supply and we reserve the right to withdraw
these at any time. We cannot be held responsible if a special
offer or any product is not available for supply after an order
has been placed.
Condition of products:
All products are brand new and delivered as supplied by the manufacturer
unless stated otherwise. In the case of DVD players, when listed
specifically as “Multi-Region” this can entail a player
modification which requires the outer carton to be opened, the
software to be updated and the player to be tested prior to dispatch.
Use of the website:
We grant you a limited right to use the website. The right is
non-exclusive, revocable, and subject to the restrictions in these
terms.
We or our licensors own all rights in the website and you shall
acquire no rights.
Except as part of ordinary use of the website, you may not copy,
reproduce, modify, download or use in any form the contents of
the website without first obtaining our permission.
Privacy policy:
Our privacy policy applies to your use of this website and to
purchases made on the site.
Ceritech Audio is committed to safeguarding the privacy of our
users while providing the highest possible quality of service.
We will only use the information that we collect about you lawfully
(in accordance with the Data Protection Act 1998) and according
to the Which? Web Trader Code of Practice.
If you have any requests concerning your personal information
or any queries with regard to these practices please contact:

Information collected - We collect the information you supply
to us through enquiry and order forms, and every time you e-mail
us. We also collect information automatically about your visit
to our site. The information obtained in this way, which includes
demographic data and browsing patterns, is only used in aggregate
form, and as such cannot be used to identify you. This aggregate
information is used to build up marketing profiles to aid strategic
development and audit usage of the site
Use of personal information - We process personal information
collected via Ceritech-Audio for the purposes of: providing the
best possible service processing any orders you may have made
conducting market research surveys running competitions providing
you with information about products and services we offer.
If you do not wish to receive information about our products
or services, or the products or services offered jointly with
or on behalf of other organisations, please state this when entering
your personal details.
Disclosures - We will not pass your information to any third
parties.

Our liability to you:
We will only be liable to you for losses (directly or indirectly)
caused by breach of our obligations, where these losses were reasonably
foreseeable by both you and us at the time that the contract for
the sale of the products came into effect. Our maximum liability
to you will be the value of the relevant products (including the
cost of delivery).
We will not be liable to you for losses that were not caused by
any breach of our obligations. If you did not enter into the Contract
with us as a consumer, we will not be liable to you for your business
losses unless such losses arose as a direct result of us breaching
the contract. We will not be liable for any delay or failure to
comply with our obligations under these terms if the delay or
failure is caused by anything beyond our reasonable control.
The above does not affect your statutory rights.
Effects of legislation:
None of the above affects your statutory rights. Where the above
conflicts with any overriding legislation, the overriding legislation
shall be applied. If one aspect of this contract is found to be
non-enforceable that shall not affect any other aspect of this
contract.
General:
Persons who are not a party to these terms shall not have any
rights under them.
We will comply with all applicable legislation and regulations,
including the Data Protection Act 1998.
These terms are governed by English law and the English courts
have exclusive jurisdiction.
